  1. Preamble
    These Terms and Conditions of Sale govern transactions and the use of customer accounts on the BlackMountain.ma website. Any order placed on this site implies the client’s full, unconditional, and irrevocable acceptance of these terms, as well as their commitment to comply with the rules and obligations detailed in this document.
  2. Purpose of the Contract
    This contract is a remote contract that aims to define the rights and obligations of the parties within the framework of the sale of products and services offered by Znaki Organization on the BlackMountain.ma website. It governs the conditions under which clients can book available accommodations and benefit from the services offered by the platform’s partners.
  3. Rates
    The rates displayed on the BlackMountain.ma website are listed in Moroccan dirhams and are valid at the time they are viewed by the client. They reflect the rates in effect at the time of order. A 20% deposit of the total price must be paid to secure the reservation through the BlackMountain (BCM) service, with the balance due upon arrival, without requiring the client to pay an excessive amount to secure their reservation. It is recommended to carefully review room descriptions and rates to understand the associated conditions before making a reservation.
  4. Payment Method
    Temporarily, Znaki Organization uses YouCan Pay for payment processing on the BlackMountain.ma payment page. The transaction is debited on the day following the reservation confirmation. YouCan Pay offers a secure multi-channel payment service to ensure the safety of transactions made on the site.
  5. Data Privacy
    The information requested from the client is necessary for processing the order and is handled with strict confidentiality. In accordance with applicable laws, the client has the right to correct their personal data. Clients may also receive promotional offers or advertisements from BlackMountain.ma unless they have expressly opted out of the use of their personal data for this purpose.
  6. Cancellation Policy
    The 20% deposit paid to secure the reservation is non-refundable. In the event of no-show on the booking date or if the client decides to cancel their stay, the reservation is automatically canceled without refund of the deposit. The client may also request a cancellation by contacting the host directly.
  7. Policy on Interruption of a Stay
    In the event that a stay in progress is interrupted, the client will lose the benefit of any discounts initially applied, and the current public rate will be reapplied. No refunds will be issued in this case.
  8. Host Commitment and Responsibility to the Client
    By registering on BlackMountain.ma, the host agrees that, once a client has paid 20% of the reservation amount, they are fully responsible for ensuring the accommodation’s availability for that client. If the client shows up and no accommodation is available, the host must pay a penalty equivalent to the total reservation price, in addition to covering any applicable compensation costs.
  9. Force Majeure
    Znaki Organization, responsible for the BlackMountain project, is only required to fulfill its obligations as long as no event of force majeure interferes. A force majeure event refers to any unforeseeable, unavoidable, and external circumstance, such as a natural disaster, pandemic, war, or strike, that makes it impossible to fulfill contractual obligations.
  10. Modification of Terms and Conditions of Sale
    Znaki Organization reserves the right to modify these Terms and Conditions of Sale at any time. Clients will be informed of changes via notifications on the site or updates within the dedicated T&Cs section. It is the client’s responsibility to regularly review the Terms and Conditions to stay informed of any changes.
  11. Limited Liability
    Znaki Organization is not responsible for the actions, omissions, or defaults of hosts beyond its own contractual obligations. In the event of a problem related to the service or accommodation, the host is responsible for resolving the dispute directly with the client.
  12. Governing Law and Dispute Resolution
    These Terms and Conditions of Sale are governed by Moroccan law. In the event of a dispute related to their interpretation or application, the parties agree to seek an amicable resolution. Failing agreement, the dispute will be submitted to the competent courts.
